Abstract: 4. Notification by John [of Oxford], bishop of Norwich, that Baldwin de Tosni and Alda his mother have granted to Prior Adam and the canons of the aldergrove in [East] Bergholt this same place called the aldergrove, at the instance of Wimer the chaplain, founder of the place, who has assigned to the canons his land at Dodnash, which he acquired from William and Maurice, sons of Hervey, and also the church of Ilurston [in Kirton] by the grant of the advocates. The canons have sworn upon the Gospels that they will not infringe the rights of the parish church, which pertains to the abbot and convent of Battle. Licence has been granted that they may bury in their own cemetery canons, members of their confraternity and others who, with the consent of their parish priest and having indemnified their parish church, choose to be buried there. Any dispute shall be settled by the common counsel of the churches of the aldergrove and Battle and the incumbent of [East] Bergholt, and if this should fail, by the arbitration of the bishop of Norwich, without recourse to any superior judge. For the lives of the two sisters the priory will pay 20d. p. a. to Matilda and 4d. p. a. to Wynmarc and the land will revert to the monks on their deaths. Abstract: 5. Notification by Maurice son of Hervey that he has confirmed the agreement made in the court of King Henry II between himself and Wimer the chaplain, concerning the land which William, Maurice's brother, sold to Wimer. It was agreed that Wimer might found thereon whatever religious community he might wish, according to the charter which he has obtained from Simon of Thunderley, capital lord of the fee. This concession Maurice has made with the assent of his heirs, for their salvation and that of their ancestors and predecessors. Abstract: 615. Carta comitisse deecclesiade Tadecastre. [25 Mar.,1189] Matilda de Percy countess of Warwick came to the rescue of Sallay abbey, her father's foundation. Situated in a foggy and rainy district, the standing crops white unto harvest ordinarily rotted in the stalk and after 40 years the house was in dire poverty, with an intolerable scarcity of food and clothing. The lord abbot of Clairvaulx and the visiting abbots had advised either the total destruction of the abbey or its removal to some spot where it might be decently maintained. The countess, with the advice of Julian of Inys and William of Mortemar, abbots-visitors; in the presence of Nicholas, dean and parson of the church of Tadcaster, and with the advice of Sir William Vavasor and other friends, granted to the abbey the church of Tadcaster, the chapel of Haselwood, the annual pension of Newton church and a carucate in Catton her birth-place.
