Sanctissimo patri ac domino Jnnocentio sacrosancte Romane sedis summo pontifici E. dictus abbas in Domo Petri1 et H. prepositus sancti Stephani || in Constantia2 Constantiensis ecclesie iudices delegati debitam obedientiam et reverentiam. Sua nobis relatione monstravit Kvonradus abbas sancti Johannis3 Constantiensis || dyocesis, quod nobilis vir Rvodolfus de Wîzenanch4 Patrimonium suum5 ecclesie sue˛ ad usum fratrum pro tempore ibi deo servientium liberaliter et legitltime pro remedio anime sue donaverit, a cuius possessione nobilis vir Volricus comes de Chiburch6 ipsum et tres antecessores eius, sicut ipse asserit, violenter eiecit. Partibus itaque coram nobis constitutis dictus abbas violentam eiectionem conquestus est. Pars vero comitis respondit, quod possessionem eiusdem predii ab eo acceperit, qui ipsum predium iure hereditavit, adiungens, quod R., qui predium ecclesie˛ dicitur donasse, tempore donationis mortalem habuerit egritudinem et ideo in preiudicium heredum dandi nullam habuerit potestatem, et hoc se probaturum promisit. Ad hec predictus abbas respondit, donationem predii factam fore a R. eo tempore, quando de rebus suis disponendi liberam habuit facultatem. Verum cum secundum consuetudinem ecclesie˛ Constantiensis quereremus in sententia, quid iuris esset super causa proposita, pro abbate sententiatum fuit, si allegata probare posset, beneficio gaudere deberet restitutionis. Pro comite vero miles quidam, qui cum eo ad iudicium accesserat, sentenciavit, quod cum de eo predio questio tractaretur, quod idem comes in sua possessione XVIII annis quasi proprium possederit, causam predii non coram ecclesiastico, sed coram seculari iudice fore tractandam. Huic opinioni laycorum turba consensum prebuit. Sed quoniam per narrationem et responsionem coram nobis lis fuerat contestata, visum fuerat abbati et clericis omnibus in ecclesiastico iudicio causam fore tractandam, ubi lis fuerat contestata. Cum igitur laycorum sententia in multitudine personarum prevaleret, abbas senciens se pregravari apostolicam audientiam appellavit, terminum constituens appellationi dominicam Invocavit. Iudicet inde sanctitas vestra.
