Original Designation: no. 263 (p.175-77). Notification by Eustace bishop of Ely that, having received a mandate from Innocent III (dated at the Lateran, 23 March 1204) that he is to hear and decide a dispute between Master John of Tynemouth rector of Upminster who had complained to the pope that the abbot (Richard) and canons have been withholding the tithe from newly cultivated land in Upminster and have refused to compensate him for his loss, the bishop has summoned Master John and the abbot's proctor and heard their arguments. Master John claims that the abbot has worked sixty acres of land in alternate years and moreover has levelled several hedges and ditches on other land (described), both in Upminster parish, and worked that land and has unreasonably withheld the tithe of produce of both pieces of land from his church. The abbot's proctor claims exemption from the payment of tithe on newly cultivated land by papal privilege but Master John denies that the land is newly tilled. An amicable settlement has been agreed whereby in Master John's lifetime the canons will pay tithe on the land which they had levelled but not on the sixty acres as long as that land is cultivated by or for them; should a layman cultivate it for his own use, tithe will be payable.
