60. Judgement by Eustace bishop of Ely and Richard archdeacon of Ely, judges delegate appointed by a mandate of Pope Innocent III (January x June 1202) in a dispute between prior Richard of Eye and Master Peter of Littlebury parson of Dennington concerning tithes in Dennington. The prior and convent shall receive the tithes of the whole demesne whether the lord of the vill works it himself or farms or leases it out. They shall receive all the tithes also, if part or all of the demesne shall be given in alms to a religious house or enfeoffed to knight-service. But if the lord or his bailiff or farmer gives part or all of the demesne to villeins by servile service or to other men by the free service of rent, then the church of Dennington shall receive all the tithes: the same shall apply if he who shall have received all or part of the demesne by knight-service shall grant it to villeins or others. The prior and convent shall have all the tithes of any part so given by servile service or by free service of rent as from the day of this agreement if it shall afterwards return to the demesne. If the 40 acres, formerly belonging to the demesne but enfeoffed before this agreement, the tithes of which the prior was seeking specifically from Peter, shall return to the demesne, the prior and convent shall receive all the tithes thereof as from the rest of the demesne.
