Final concord before itinerant justices at Lancaster whereby Thomas [III] of Moulton and his wife Matilda, in exchange for the surrender to them by Walter, Prior of Lanercost, of the manor of Great Askerton as rightfully Matilda's- (1) confirm land at Brenkibet and between Hartley Burn and Black Burn [bounds stated), with the right to make twenty messuages, and also vaccaries, bercaries, and shielings, together with the right to have a shieling next Hellegille [Howgill?] in Tindaleside, and with pasture in Blackburnside, Tindaleside, and Brenkibet Moor, turbary, and rights of way (reserving the right to cultivate in the same area provided sufficient pasture remains); (2) confirm lands (bounds stated, north-east of the confluence of the Irthing and the King), both those held by Thomas and Matilda and by the Prior, saving the homage of Matilda of Denton for her tenement there, with common pasture (except for the men of Eyketon) in Walton Wood, reserving the right to cultivate, etc.; (3) concede freedom from escape-fine, but with reparation for damage if the stock of the Prior or of his men of Cumquenecath stray into the manor of Askerton, or if that of the Priory or its men of Banks, Burtholme or Eyketon cross the Irthing; (4) grant six acres in Brampton next the Irthing between Polteman [Castle Beck] and Becfarlam [Milton Beck], with permission to enclose; (5) concede the enclosure of the park of Warthcoleman, without a deer-leap; (6) concede the right for the prior and his men of Cumquenecath to keep pigs in Walton Wood free from pannage, and to have the pannage of the pigs of all his men of Gilsland for ever, provided that if the pigs of men other than those of Cumquenecath are pastured in the grantors' woods at mast-time, they will pay pannage; (7) allow the Prior to have two woodwards in his demesne who shall before exercising their powers, swear in the grantors' court of Irthington faithfully to observe the grantors' hunting rights; (8) allow the Prior to have four leviers and four brackets to hunt foxes and hares and other game called clobest in his own demesne lands and woods; (9) allow the prior's men to carry bows and arrows on the roads and paths throughout the barony of Gisland provided they do not injure the wild beasts of Gisland forest; (10) allow the prior to make enclosures in the aforesaid lands provided that the wild beasts have egress except in the park of Warthcoleman ; (11) allow common of turbary for the prior's servants and shepherds on Brenkibet moor.
