Eapropter noverint omnes, quos nosse fuerit oportunum, quod ur||gente nos onere debitorum de consensu heredum nostrorum ac aliorum, quorum intererat, possessiones nostras in Bregensdorf2 et in Ranwile3, quas a monasterio sancti Galli in feodum tenulimus et possedimus, quasque . . abbati dicti monasterii sancti Galli liberaliter resignavimus, honorabilibus in Christo . . abbati et conventui monasterii in Salem4 cum pratis, agris, pascuis, cultis et mcultis, pomeriis, silvis, aquis, aquarumve decursibus, viis, inviis necnon Walthero dicto de Bregensdorf, . . uxore ac liberis suis utriusque sexus tam genitis quam gignendis, iurisdictionibus necnon pertinentiis et iuribus universis tam corporalibus quam incorporalibus, quocumque nomine censeantur, adhibitis verborum ac gestuum sollempnitatibus debitis et consuetis rite et legittime vendidimus pro ducentis et decem et novem marcis argenti puri et legalis ponderis Constanciensis, quod nos recepisse ac in evidentes nostros usus converrisse profitemur, renuntiantes pro nobis nostrisque heredibus universis circa premissa omnia benefitio restitutionis in integrum, principaliter vel incidenter, exceptioni non numerate pecunie, litteris a sede apostolica vel aliunde impetratis vel impetrandis, defensioni non adhibite sollempnitatis, omnibus constitutionibus et statutis tam editis quam edendis, constitutionibus generalibus, particularibus et localibus quibuscumque et generaliter omni suffragio tam in spetie quam in genere, quo mediante predicta venditio possessionum et hominum ullo unquam posset tempore violari. Nichilominus nobiles et strennuos viros dominos Hvgonem comitem de Werdenberch5, Rvodolfum et Diethalmum dictos de Gvttingen6, Johannem de Bodemen7, Rvodolfum et Hermannum fratres de Svlzberch8, Marquardum et Volricum fratres de Schellenberch9, Johannem de Schoenenberch10, Rvodolfum de Stainach11, Volricum dictum Giel de Glatburg12 milites et Cvonradum de Castello13 abbati et conventui predictis obligavimus fideiussores in solidum pro eo videlicet, quod cum liberi Burchardi Dietrici quondam germani nostri14 ad legittime etatis annos pervenerint, prescripta omnia litteris et sigillis suis ratificabunt ac sine dolo rata perpetuo observabunt. Quod si non fieret, prescripti fideiussores, sicut prestito sacramento corporali promiserunt, moniti ad obstagium in civitate Constanciensi se presentabunt nullatenus exituri, donec per eosdem liberos prescripta omnia compleantur. Si vero aliquem predictorum fideiussorum medio tempore cedere vel decedere contigerit, nisi alter infra quindenam per nos eque bonus substitutus fuerit, superstites ad obstagium se recipient inde non recessuri, donec alter ydoneus cedenti vel decedenti fuerit subrogatus. Insuper obligamus nos nostrosque heredes predictis abbati et conventui ipsorumque successoribus per stipulationem sollempnem et legittimam ad subeundum pro ipsis in quocumque iuditio ecclesiastico vel civili in premissis omnibus plenam warandiam omneque periculum evictionis sine ipsorum laboribus et expensis.
