XXXVIII. Record of an agreement made before Hubert Walter, archbishop of Canterbury, whereby the monks of Bec lease the church of Cleeve, a prebend of Wells, with all its appurtenances to the monks of Cleeve for 44 marks annually. The monks of Cleeve may not alienate the church without the consent of the convent of Bec, and in legal proceedings they may vouch the convent to warranty. Date: 1199. Noverint tam presentes quam futuri quod Willelmus abbas et conventus Beccensis monasterii de communi consilio et assensu domini Savarici Bathon[iensis] episcopi nec non decani et capituli Wellensis ecclesie concesserunt ecclesiam suam Sancti Andree de Cliva que est prebenda Wellensis ecclesie abbati et monachis de Cliva in suo perpetuo tenend et habend cum omnibus ad eandem ecclesiam pertinentibus reddendo inde eidem abbati et conventui Becci ecclesie annuatim apud Maiorem Ockeburnam pensionem 44 marcarum sterlingarum in duobus terminis anni scilicet in festo sancti Martini in hyeme 22 marcas in festo sancti Iohannis Baptiste 22 marcas et quia monachi Cisterciensis ordinis multis gaudent privilegiis dicti abbas et monachi de Cliva concesserunt et suo autentico confirmaverunt quod si aliquo tempore contigerit eos cessare a solucione pretaxate pensionis et super hoc requisiti pensionem detentam non solverint ecclesiam ipsam de Cliva eisdem abbati et conventui de Becco liberam sine ullo impedimento dimittent et nihilominus pensionem detentam integre eis persolvent insuper et omnes decimas suas de terris et animalibus infra diocesim predicte ecclesie de Cliva provenientes non obstantibus privilegiis suis a sede apostolica impetratis vel impetrandis sine ulla retencione eisdem abbati et monachis de Becco persolvent sed et idem abbas et conventus de Becco memoratis abbati et monachis de Cliva concesserunt quod si ipsi aliquando contra prefatam concessionem suam venerint et super hoc requisiti non satisfecerint liceat eisdem abbati et monachis de Cliva ipsis abbati et conventui de Becco sepedictam ecclesiam de Cliva resignare et libere suis privilegiis uti in omnium decimarum suarum retencione Dicti quoque abbas et monachi de Cliva nullam transactionem vel communicacionem de iamdicta ecclesia de Cliva aliter poterunt facere nisi ille vel illi qui eam suscipient se prius abbati et monachis de Becco obligaverunt ad composicionem istam tenend et prefatam pensionem 44 marcarum eis fideliter reddendam Si quis autem contra dictos monachos de Cliva super memorata ecclesia vel aliquo quod eadem ecclesia tempore huius concessionis inite possederit litem suscitaverit dicti abbas et conventus de Becco suis expensis eos warantizabunt per se vel per procuratorem suum ad eorum peticionem ad hoc destinatum Quod si super aliquo quod predicta ecclesia tempore huius convencionis inite non possederit litem alicui inferant vel patiantur suis expensis agant vel conveniantur Ut igitur hec per temporum successionem rata et inconcussa permaneant presenti scripti testimonio et sigillorum partis utriusque sunt roborata patrocinio Actum anno gracie mcxcix in presencia domini H Cantuar[iensis] archiepiscopi Godefridi Camerac [ensis] archidiaconi S Wellensis archidiaconi magistri Roberti de Glemefort magistri Iohannis de Tinemua magistri Willelmi de Sumercote Magistri Ade de Walsingueham magistri Iohannis de Kenouvill[] Iohannis de Sancto Edmundo
