Anno regni regis Edwardi filii regis Edwardi quarto coram domino Johanne de l[]Yle et Johanne de Doncastre tunc justiciariis assignatis domini regis apud Ebor associato eisdem domino Henrico de Scrop tunc justiciario domini regis in banco comitatus capta fuit hec assisa nove disseisine die martis proximo post festum sancti Mathei inter Johannem de Houeden abbatem de Sallai petentem et Willelmum de Marton et alios in brevi deforciantes etc Assisa venit recognoscere si Willelmus de Marton Johannes le Strang[] Hugo Scot Willelmus Neubrid Robertus Cordewan Willelmus Scot Johannes filius Cecilie et Robertus de Marton injuste etc diss[] abbatem de Sallai de communa pasture sue in Marton post primam etc et unde queritur quod diss[] eum de communa pasture sue communicandi cum sexcentis ovibus per majus centum [in ducentis] acris more a festo Omnium Sanctorum usque primum diem Mai et a primo die Mai usque ad idem festum Omnium Sanctorum cum quadringentis ovibus per majus centum in predictis ducentis acris more per factum speciale etc Et Willelmus de Marton venit et alli non veniunt scilicet quidam Patricius de Barton respondit pro eis tanquam eorum ballivus et dicit quod ipsi nullam injuriam aut disseisinam predicto Abbati inde fecerunt et de hoc ponit se super assisam et predictus W de Marton dicit quod predictus abbas nuncquam fuit seisitus de predicta communa communicandi etc ita quod potuit inde diss[] et de hoc ponit se super assisam et predictus abbas dicit quod ipsi et predecessores sui fuerunt in seisina de predicta communa quousque predictus Willelmus de Marton et alii ipsum inde injuste etc diss sicut queritur et petit quod inquiratur per assisam et predictus W de Marton similiter Ideo capiatur assisa etc Jurati dicunt super sacramentum suum quod quidem Petrus filius Willelmi de Marton tunc dominus ville predicte dedit et concessit et per cartam suam confirmavit Deo et beate Marie de Sallay et monachis ibidem Deo servientibus predictam pasturam ad certum numerum averiorum et quod predecessores ipsius abbatis a tempore concessionis predicte seisiti fuerunt de predicta pastura et similiter iste abbas qui nunc est seisitus fuit de eadem pastura quousque predictus Willelmus de Marton et omnes alii ipsum inde injuste etc diss[] sicut queritur Ideo consideratum est quod predictus abbas recuperet inde seisinam suam per visum recognitorum et similiter dampna que taxantur per eosdem ad dimidiam marcam et predicti Willelmus de Martona et alii in misericordia etc
