Notum sit omnibus hoc scriptum visuris vel audituris quod cum querele mote essent inter abbatem et conventum de Fontibus ex una parte et abbatem et conventum de Sallai ex altera causa illa commissa est a capitulo generali abbatibus de Rievalle et de Rutf[] pace vel judicio terminanda Die autem partibus prefixa accesserunt judices personaliter ad loca unde contencio fuit et inquisita diligenter veritate quere ex consensu partium hoc fine conquieverunt videlicet quod de via de Lonesdale que fuit in contencione que esset antiqua et que nova per Braihwithes arbitrio judicum posita est in veredicto quatuor militum vel legalium virorum qui non sint suspecti alterutri parti et sicut ipsi dixerunt in sua veritate que et ubi solet esse antiqua via de Lonesdal ibi sit certa divisa inter partes inperpetuum Concesserunt eciam monachi de Fontibus monachis de Sallai presentibus dictis judicibus communam pasture super Lothenrig[] et Waltherb[] ad falcandum ibidem fenum et coopertorium ad omnia necessaria sua et hominum suorum de Langclif et de Stainforde salva dictis monachis de Fontibus foresta sua sicut usitata est temporibus Ricardi de Perci quando eam eis dedit per has divisas scilicet de Ulkilcros sicut foresta se extendit usque ad Sandwath versus pasturam de Stainforde et de Sandwath usque ad Braithwites in antea sicut via que venit de Lonesdal se extendit Concesserunt eciam monachi de Fontibus quod non depascent maliciose dictam pasturam quin monachi de Sallai habeant ad falcandum sufficient[] ad necessaria sua Concesserunt eciam quod si aliquo tempore per legem terre adjudicata fuerit possessio fundi dicte pasture alicui exigenti monachi de Sallai habebunt inde afferantum suum Et monachi et conversi de Sallai promiserunt in fide et veritate coram judicibus quod nuncquam sollicitabunt vel instigabunt aliquem ad aliud impetrandum vel placitandum super proprietate fundi dicte pasture Item de Coupmanhusflasckes providerunt dicti judices pro pace utriusque partis quod si averia de Fontibus sine custodia facta inveniantur in Flaskes non inparcabuntur sed sine lesione recaciabuntur De Litton ita provisum est per judices quod monachi de Sallai habebunt in pastura de Litton extra forestam de Littondale tot oves quot continetur in cartis suis scilicet septingentos et quadraginta oves et insuper afferantum terre sue de Littona scilicet justam estimacionem et visum bonorum et legalium virorum sine superhoneracione pasture Concesserunt eciam eisdem monachis de Sallai ut de quatuordecim bovatis suis quas habent in dominico in villa de Litton habeant afferantum septem bovatarum de prato clauso extra murum et si poterunt tantum facere erga liberos homines de Littona quod habeant partem suam separalem in uno loco in illo prato bene placebit monachis de Fontibus et pro eis partes suas rogando interponent Item concesserunt monachis de Sallai ut habeant ingressum in bosco ad averia sua temporibus et locis quibus habere solebant temporibus domini Ricardi de Perci scilicet a festo Omnium Sanctorum usque ad festum apostolorum Philippi et Jacobi ita quod ibidem non pernoctent sed ad communem pasturam ante noctem redeant Determinaverunt eciam judices quod elemosina de Littona et de Littondal collata in pios usus ad opus conventus de Fontibus et a capitulo generali confirmata inperpetuum maneat in statu tali in quo fuit quando ista provisio per judices facta fuit pro bono pacis utriusque partis Et ut ista judicialis provisio perpetuam optineat firmitatem dicti judices sigilla sua una cum sigillis partium huic scripto apposuerunt Datum die exaltacionis Sancte Crucis anno gracie m cc l primo
