621. Composicio inter abbaciam sancte Marie Ebor. et domum. de Salleya. [12 Aug., 1265] A dispute arose between the abbey of St. Mary's, York, and Sallay abbey during the rule of abbot Hugh, concerning the tithes of 3 acres in Smaws field. Hugh said the tithes belonged to Sallay by reason of the church of Tadcaster, while St. Mary's maintained that the land and tithes belonged to the parish and demesne of Newton. Mutual friends intervening, Sallay agreed to renounce the tithes and St. Mary's to pay to Sallay annually at Tadcaster grange 1 lb. of pepper or 12d. Cf. Towneley MS. 6, p. 58. In nomine Domini amen Cum inter viros religiosos scilicet abbatem et conventum sancte Marie Ebor ex parte una Hugonem abbatem de Salleya et ejusdem loci conventum ex altera super quibusdam decimis provenientibus de tribus acris terre et dimidia quas dominus W de Kym habuit in campo de Smaus juxta terram Radulphi de Smaus ex parte orientali orta fuisset absque litis instancia materia questionis eo quod dicti abbas et conventus de Sallai dicebant dictas decimas ad eos racione ecclesie de Tadecastre quam in usus proprios detinent pertinere et dictos abbatem et conventum sancte Marie Ebor dictas decimas in eorum prejudicium indebite percipere dictis abbate et conventu sancte Marie Ebor econtrario asserentibus dictas terras et decimas esse de parochia de Neutona ac de dominicis ejusdem loci sicque ad ipsos pertinere Tandem mediantibus amicis communibus in hunc modum conquievit videlicet quod abbas et conventus sancte Marie Ebor sponte et pro bono pacis voluerunt et promiserunt se solituros abbati et conventui de Sallai apud grangiam suam de Tadecastre monacho vel converso eorundem ibidem invento singulis annis quibus dicta terra fuerit seminata unam libram piperis vel xij denarios utrum abbas et conventus sancte Marie Ebor voluerint in festo Assumpcionis beate Virginis et dicti abbas et conventus de Sallai promiserunt quod dictos abbatem et conventum sancte Marie Ebor super dictis decimis nullatenus molestabunt juri si quod habuerunt in peticione decimarum trium acrarum terre et dimidie penitus renuntiantes salvo tamen eis redditu supradicto In cujus rei testimonium huic carte inter partes cyrographate dicte partes signa sua alternatim apposuerunt Actum apud Ebor die Mercurii proxima post festum sancti Laurencii anno Domini m cc lx quinto
