M[ichaell of Hampstead, archdeacon of Carlisle, records that he will excommunicate Odo of Skirwith, summoned at the instance of the prior and canons of Lanercost, should he fail to fulfil his undertaking (no. 207) for payment of a rent of half a mark; the sentence will only be lifted when Odo has paid half a mark to the poor, over and above the half mark penalty. Memorandum quod anno Domini m cc Ix quarto die Lune proxima ante annunciationem beate Marie virginis in ecclesia maiore Karl[] coram nobis magistro M de Hamsted archidiacono Karl[] comparuit Eudo Sckyrwit ad instanciam prioris et conventus de Lanrecost[] evocatus super crimine perjurii quod coram nobis ipsum incurrisse Per modum denunciationis instanter asserebant quod per exibitionem cuiusdam obligationis sigillo Eudonis signate cui ex nunc ad maiorem fidem faciendam utraque parte procurante sigillum nostrum duximus apponendum parati fuerunt in forma juris probare Consequenter dicti prior et conventus nobis humiliter supplicantes postulabant ut eorum indempnitati ac quieti nec non saluti prefati e[udonis] ne juramenti sui religionem violare presumat salubriter prospicere curaremus habend respectum ad labores et dampna quos hactenus occasione dicte obligationis non observate sustinuerunt Memoratus siquidem Eudo suum vix valens diffiteri delictum nostre jurisdictioni se supposuit consentiens instanter que rogans quod si ad terminum in pretacta obligatione insertum vel infra octabis eiusdem eisdem religiosis de dimidia marca competenter non satisfaceret extunc excommunicationis maioris sententia esset ligatus et dimidiam marcam pauperibus erogandis nobis citra excommunicationis relaxationem persolveret salva etiam et nobis et prefatis priore et conventui exactione dimidie marce nomine pene in obligatione sepedicta contente nobisque persequendi perjurum si contingat ab ipso committi quod absit potestate Nos igitur ut utrique parti quies ac salus paretur et litigandi materia amputetur predictum e[udonem] extunc in scriptis periculo excommunicationis maioris innodamus si placitis obligationem predictam contentis parere et satisfacere ut premissum est non curaverit quam faciemus Deo auctore firmiter observari et in personam ipsius per totam jurisdictionem nostram usque ad satisfactionem utriusque prescripte pene et perjurii emendationem accensis candelis pulsatis campanis solempniter denunciari et puplicari et quia maliciosis potius est obviandum quam indulgendum Hinc ad testificanda premissa eundem e[udonem] cum sigillo nostro sigillum suum presentibus fecimus appendere
