4. Notification by John [of Oxford], bishop of Norwich, that Baldwin de Tosni and Alda his mother have granted to Prior Adam and the canons of the aldergrove in [East] Bergholt this same place called the aldergrove, at the instance of Wimer the chaplain, founder of the place, who has assigned to the canons his land at Dodnash, which he acquired from William and Maurice, sons of Hervey, and also the church of Ilurston [in Kirton] by the grant of the advocates. The canons have sworn upon the Gospels that they will not infringe the rights of the parish church, which pertains to the abbot and convent of Battle. Licence has been granted that they may bury in their own cemetery canons, members of their confraternity and others who, with the consent of their parish priest and having indemnified their parish church, choose to be buried there. Any dispute shall be settled by the common counsel of the churches of the aldergrove and Battle and the incumbent of [East] Bergholt, and if this should fail, by the arbitration of the bishop of Norwich, without recourse to any superior judge. Comment

Date: The church confirmed cannot be Thurston, in Thedwardestre hundred, as incorrectly identified by the present editor in EEA vi, no. 211, as the monks of Bury paid a pension of 13s 4d p. a. to the bishop of Norwich for this church (Register of John Morton, Archbishop of Canterbury, 1486-1500 iii, no. 193). It is almost certain that this church was Kirton, in Colneis hundred, of which parish 'Sterston' or Strewston (DB Struustuna) was certainly a hamlet, and the distinct 'Terston' or Thurston (DB Turstanestuna) possibly so. See also no. 111, and for full discussion no. 123n. This actum refers to East Bergholt as a parish church, but other sources from the twelfth to the early sixteenth century have it as a chapel within the parish of Brantham; see Introduction, p. 4, n. 17.
