Clemens episcopus seruus seruorum dei. Dilectis filiis . . . preposito, Erboni et Kalhoho canonicis ecclesie Ratisponensis salutem et apostolicam benedictionem. Transmissa nobis venerabilis frater noster . . . episcopus Frisingensis patronus ecclesiarum de Weidhouen, de Aspach et de Helensten (!) Patauiensis diocesis peticione monstrauit, quod cum felicis recordacionis Vrbanus papa predecessor noster causam que inter ipsum ex parte una et . . . abbatem et conuentum monasterii de Sicansteten (!) ordinis sancti Benedicti eiusdem diocesis ex altera super iure patronatus ecclesiarum ipsarum et rebus aliis vertebatur, ab audiencia magistri Gerardi canonici Patauiensis auctoritate apostolica cognoscentis de ipsa per appellacionem legitime ad apostolicam sedem delatam . . . abbati monasterii de Thirhoupt per suas litteras duxerit committendam, idem abbas de Tirhoupt magistro Marquardo scolastico Augustensi commisit super hoc usque ad diffinitiuam sententiam uices suas. Sed iidem abbas et conuentus de Sitansteten sufficienti conficto grauamine ab audiencia dicti subdelegati ad sedem apostolicam appellarunt, quorum appellationem prefatus subdelegatus friuolam reputans prout erat, finito apellacionis articulo rite aliquandiu processit in causa et demum ad dictum abbatem de Tirhoupt remisit eandem, qui cognitis ipsius cause meritis et iuris ordine obseruato pro eodem episcopo diifinitiuam sentenciam promulgauit, eosdem abbatem et conuentum in quadam summa pecunie ipsi episcopo expensarum nomine condempnando, que sentencia nulla legittima procuracione suspensa in rem transiit iudicatam. Wernerus quoque perpetuus vicarius in Welc~, Salceburgensis diocesis quem nominatus abbas de Tirhoupt executorem uice sui constituerat quoad sentenciam ipsam execucioni debite demandandam, in Rudolphum abbatem dicti monasterii de Sicanstanten (!) eidem diffinitiue parere contumaciter denegantem excommunicacionis sentenciam exigente iusticia promulgauit, quam ipse Rudolphus abbas dampnabiliter uilipendens diuina officia celebrare, immo quantum in eo est, uerius prophanare presumit in anime sue periculum, dicti episcopi preiudicium et ecclesiastice discipline contemptum. Quare fuit pro parte ipsius episcopi nobis humiliter supplicatum, ut easdem sentencias curaremus apostolico munimine roborare ac eundem Rodulphum abbatem pro huiusmodi presumpcionis excessu puniri pena canonica mandaremus. Quocirca discrecioni vestre per apostolica scripta mandamus, quatenus sentenciam ipsam diffinitiuam sicut est iusta, per censuram ecclesiasticam, excummunicacionis vero sicut rationabiliter est prolata, faciatis auctoritate nostra usque ad satisfactionem condignam appellacione remota inuiolabiliter obseruari. Super eo autem, quod predictus Rudolphus abbas sie ligatus diuina dicitur officia temere celebrare quod canonicum fuerit, appellatione postposita statuatis, facientes quod decreueritis, per censuram eandem firmiter obseruari. Quod si non omnes hiis exequendis potueritis interesse, duo vestrum ea nichilominus exequantur. Datum Perusii, XVI. kal. Maii, pontificatus nostri anno primo.
