Abstract: Original Designation: no. 477 (p. 332-34). Final concord made in the king's court before six named justices between Simon II le Bret and Abbot Richard by his attorney Robert of Hertford concerning a messuage; between Simon and Alan the clerk of Wrangle by his attorney Stephen of Ware about a messuage; between Simon and John of Leverton and his wife Alveva by her husband about three bovates and twenty acres of land; between Simon and Jordan son of Oukes by his son Abraham about one bovate and nine acres of land all in Wrangle whereby Simon remits and quitclaims to the other parties all his right and claim in these tenements. In return Abbot Richard grants to Simon forty two acres and one perch of land which had been granted to the canons by Simon's father Simon le Bret. In addition Abbot Richard grants to Simon the homage and service of eleven named tenants in Wrangle with one third of all the abbot's common pasture and half a fishery at Leake, rendering one pound of pepper on St Botulf's day. Furthermore Simon grants and quitclaims to the abbot all the other tenements which had been granted to the canons by his father in Wrangle and Leake but with the addition of the saltpan, toft and seashore granted by Roger de Stratton, but omitting from there the tenement and service of the parties to the actions. Abstract: 64. Judgement by abbot Hugh and prior Richard of Bury St Edmunds and prior Adam of Ixworth, judges delegate appointed by a mandate of Pope Honorius III (30 March 1219), in a dispute between the prior and convent on the one hand and William the treasurer of York, vicar of the church of Stradbroke and John of Louvain, clerk, parson of Stradbroke on the other, concerning the tithes of the assart called Bradeleye in Stradbroke which the monks claim belong to them on the grounds that they received the tithes of pannage before the land was brought into cultivation, and they seek compensation for the tithes lost for the previous 5 years. John of Louvain claims that the tithes belong to his church by parochial right because the land is within the parish, that the bishop has no right to confirm them to another church or monastery, that the founder of Eye was not patron of the church of Stradbroke and that his church has taken the great and lesser tithes for the last 40 years. Master Laurence of Lincoln, proctor of William treasurer of York, claims the same and states that the monks never received the tithes of acorns, nuts and fruit when the land was a wood. The judges uphold the claim of the prior and convent and William is to pay them 12m for the tithes taken for the previous 5 years and John and William are to pay the monks 5m for expenses incurred in the litigation.
